Terms of Use and Conditions of Sale

This document integrates: (i) the **Terms of Use** of the website and digital services and (ii) the **Conditions of Sale** applicable to online purchases. By using the website or making a purchase, you accept this Agreement. Designed in accordance with EU and Spanish regulations (consumer, e-commerce, guarantees), without prejudice to mandatory consumer rights in your EEA country.

We operate as a seller established in Spain for orders within the EEA.
2. Key definitions
“Website”: fluyebottle.eu and subdomains. “Customer”/“Consumer”: natural person acting for non-professional purposes. “Company”/“B2B”: legal entity or professional. “Personalized Products”: goods manufactured/altered according to your specifications (engraving, screen printing, etc.).
3. Scope of application and changes to the Agreement
Applicable to the access/use of the Website and to all online purchases. We may update these conditions for legal or operational reasons; the current version is the one published on this page. Orders are governed by the version in force at the time of **order confirmation**.
4. Capacity to contract and user account
You must be over 18 years of age and have legal capacity. If you create an account, you are responsible for its use and safekeeping. Notify us of any unauthorized use.
5. Pre-contractual information and error correction
Before payment, we display essential characteristics, total price (including taxes), shipping costs, and restrictions. You can review the order and correct errors before payment. We retain electronic evidence of the contract; you may request a reasonable copy.
6. Purchase process and order acceptance

We may reject orders due to suspected fraud, lack of stock, incorrect data, or non-compliance with these conditions (full refund if applicable).
7. Prices, taxes, and manifest errors
Prices in **euros**, VAT/IGIC/IPSI according to destination. We may update prices without affecting confirmed orders. If we detect a **manifest error** in price or description, we may cancel or correct the order with a full refund if you have already paid.
8. Promotions, coupons, and transparency
Discounts are not cumulative unless otherwise stated. For sales, we show, where applicable, the **lowest previous price** of the last 30 days for the same channel/country. Customer reviews indicate if they come from a **verified purchase**; we do not incentivize paid reviews or hide them unless they violate usage rules.
9. Shipping, delivery times, and delivery
We ship to Spain and EEA countries enabled at checkout. Delivery dates are indicative. Delivery is understood to be made upon acquiring physical possession. Carrier incidents or force majeure may affect deadlines.
**Inability to deliver**: if delivery cannot be made due to reasons attributable to the customer (incorrect address/absence), we will reschedule upon payment of additional costs.

10. Transfer of risk and retention of title
Risk is transferred to the consumer upon delivery. **Ownership** of the goods is transferred once full payment has been received (retention of title).
11. Right of withdrawal
Period: 14 calendar days from delivery (or the last delivery in multiple orders). How to exercise it: send us an email indicating the order number and goods to be returned. We will confirm receipt.
Refund: we will refund payments including initial **standard** shipping costs without undue delay and, at most, within 14 days of your communication; we may withhold until we receive the goods or conclusive proof of return.
Product condition: responsible for depreciation due to handling beyond what is necessary to establish nature, characteristics, and functioning.
Return costs: you can return at your own expense (at your charge) or use **our label**. If you use our label in peninsular Spain, we deduct **€3.50** per order. In other areas/countries, the cost will be shown and deducted. **Free** in case of defect/warranty or our error.
12. Legal exclusions to withdrawal
Does not apply to: (i) **Personalized Products**; (ii) sealed goods not suitable for return for health/hygiene reasons if unsealed; (iii) services fully performed with your consent; and other legal provisions.
13. Exchanges by preference (color/model)
Manage an exchange within 14 days as a withdrawal and place a new order. Subject to stock availability.
14. Personalized Products — content, licenses, and tolerances
You declare that you have the necessary rights to the texts/logos/works supplied and guarantee that they do not infringe third-party rights or applicable regulations. We may reject offensive, illegal, or content contrary to our values.
**Limited license**: you grant us a non-exclusive and free license to manufacture/deliver the personalized order and provide support. We may display photos of the final product anonymously for portfolio purposes, unless you request otherwise before manufacturing.
**Technical tolerances**: there may be reasonable color variations between devices and the actual finish; also in size/position of engraving. Images on the Website are illustrative.
15. Safe use and product maintenance
To preserve finishes and functionality: do not use in microwave, oven, or steam or boiling disinfection systems; avoid freezing; be careful with carbonated or very hot drinks due to overpressure; hand wash with warm water and soap, and avoid chlorinated substances. Dishwasher may affect paint/finishes. Consult the product sheet for compatibility. Store the product clean and dry, uncapped and away from heat sources. Keep out of reach of children if not under adult supervision.
16. Legal warranty
All products have a legal warranty in the EU of 2 years against lack of conformity from delivery. This warranty does not cover damage due to improper use, bumps, falls, unauthorized handling, or normal wear and tear.
17. Fluye lifetime commercial warranty
If your Fluye has a manufacturing or material defect, we replace it. This does not cover normal wear and tear, bumps, or damage from misuse.
Some commercial warranties are detailed by model and do not affect your legal rights.
18. B2B purchases (companies and professionals)
For sales to companies/professionals: the consumer right of withdrawal does not apply; total liability for claims is limited to the amount effectively paid for the affected order, except in cases of fraud or gross negligence; exclusive jurisdiction of Barcelona, Spain.
19. Intellectual property and unauthorized uses
Trademarks, designs, and content belong to Fluye or its licensors. Their reproduction or exploitation without authorization is prohibited. Unauthorized **resale** and uses that create confusion with the brand are prohibited.
20. Customer reviews (UGC) and moderation
We may publish reviews and Q&A. We indicate when a review comes from a verified purchase; we moderate to remove spam, offensive language, or personal data. We do not pay for reviews or alter them, except for compliance or formatting reasons.
21. Personal data and cookies (GDPR/LSSI)
Your privacy is governed by our **Privacy Policy** and **Cookie Policy** available on the Website. We may send you electronic commercial communications about products similar to those purchased; you may **object** at any time.
22. Sustainability, packaging, and recycling (EPR)
We manage our packaging in accordance with extended producer responsibility systems (where applicable) and encourage proper sorting. Consult the recycling instructions on the package.
23. Force majeure
We will not be liable for non-performance due to causes beyond reasonable control (e.g., natural disasters, strikes, global logistics incidents, supplier interruptions).
24. Customer service, complaint forms, and ODR

25. Assignment, partial nullity, and entire agreement
We may assign our contractual position within the framework of corporate reorganizations. The nullity of one clause will not affect the rest. This Agreement, together with linked policies, constitutes the entire agreement between the parties regarding the Website and online purchase.
26. Applicable law and jurisdiction
Spanish law applies, without prejudice to mandatory rules of the consumer's country of residence. Consumers: courts of their domicile. B2B: courts of Barcelona, Spain.
27. Languages and electronic communications
If there are several versions, in case of discrepancy, the Spanish version prevails unless local requirements dictate otherwise. You agree to receive contractual communications by electronic means.
