This document combines: (i) the **Terms of Use** for the site and digital services and (ii) the **Sales Conditions** for online purchases. By using the site or making a purchase, you accept this Agreement. Designed in line with EU and Spain regulations (consumer protection, e-commerce, warranties), without prejudice to mandatory consumer rights in your EEA country.

We operate as a seller established in Spain for orders within the EEA.

2. Key definitions

Site: fluyebottle.com and subdomains. Customer/Consumer: a natural person acting for non-professional purposes. Business/B2B: a legal entity or professional. Customized Products: goods manufactured/altered according to your specifications (engraving, screen printing, etc.).

3. Scope and Contract Changes

Applies to access/use of the Site and all online purchases. We may update these conditions for legal or operational reasons; the current version is the one published on this page. Orders are governed by the version current at **order confirmation**.

4. Capacity to Contract and User Account

You must be 18+ and have legal capacity. If you create an account, you're responsible for its use and safekeeping. Notify us of unauthorized use.

5. Pre-contractual Information and Error Correction

Before payment, we show essential features, total price (taxes included), shipping costs, and restrictions. You can review your order and correct errors before paying. We keep electronic evidence of the contract; you can request a reasonable copy.

6. Purchase Process and Order Acceptance

We can reject orders due to suspected fraud, lack of stock, incorrect data, or breach of these conditions (full refund if applicable).

7. Prices, taxes and obvious errors

Prices in **euros**, VAT/IGIC/IPSI according to destination. We may update prices without affecting confirmed orders. If we detect an **obvious error** in price or description, we may cancel or correct the order with full refund if you've already paid.

8. Promotions, coupons and transparency

Discounts are not cumulative unless stated otherwise. During sales we show, where applicable, the **lowest previous price** from the last 30 days for the same channel/country. Customer reviews indicate whether they come from a **verified purchase**; we don't incentivize paid reviews or hide them unless they breach usage rules.

9. Shipping, timeframes and delivery

We ship to Spain and enabled EEA countries at checkout. Delivery dates are indicative. Delivery is considered complete upon taking physical possession. Courier incidents or force majeure may affect timeframes.

**Impossible delivery**: if delivery can't happen due to causes attributable to the customer (wrong address/absence), we'll reschedule pending payment of additional costs.

10. Risk transfer and retention of title

Risk transfers to the consumer upon delivery. **Ownership** of the goods transfers once full payment is received (retention of title).

11. Right of withdrawal

Deadline: 14 calendar days from delivery (or last delivery for multi-item orders). How to use it: email us with your order number and items you want back. We'll confirm we got it.

Refund: we'll send back your payment including initial **standard** shipping costs without unnecessary delay, max 14 days from your message. We can hold the refund until we receive the items back or solid proof of return.

Product condition: you're responsible for any wear beyond what's needed to check what it is, how it works, and what it does.

Return costs: you can send it back yourself (on your dime) or use **our label**. Using our label in mainland Spain? We'll knock off **€3.50** per order. Other areas/countries show the cost upfront and we deduct it. **Free** if it's defective, under warranty, or our mistake.

12. Legal exceptions to returns

Doesn't apply to: (i) **Custom Products**; (ii) sealed items not safe to return if opened for health/hygiene reasons; (iii) services fully completed with your go-ahead; and other legal cases.

13. Swaps for preference (color/model)

Handle a swap within 14 days like a return and place a new order. Subject to stock.

14. Custom Products — content, rights and tolerances

You confirm you own the rights to any text/logos/work you give us and guarantee it doesn't breach anyone else's rights or break any laws. We can reject content that's offensive, illegal, or against what we stand for.

**Limited License**: we grant you a non-exclusive, royalty-free license to manufacture/deliver your custom order and provide support. We may display anonymized photos of the final product for portfolio purposes, unless you request otherwise before manufacturing.

**Technical Tolerances**: reasonable color variations may occur between devices and actual finish; also in engraving size/position. Images on the Site are illustrative.

15. Safe use and product maintenance

To preserve finishes and functionality: don't use microwaves, ovens, steam or boiling sterilization systems; avoid freezing; be cautious with carbonated or very hot beverages due to overpressure; hand wash with warm water and soap, and avoid chlorinated substances. Dishwashers may affect paint/finishes. Check the product sheet for compatibility. Keep the product clean and dry, uncapped and away from heat sources. Keep out of reach of children unless under adult supervision.

16. Conformity and legal warranty

If you detect non-conformity, contact us with proof of purchase and evidence. Spain: **3 years** legal warranty from delivery; in the rest of the EEA, at least the mandatory legal period (≥2 years). Does not cover normal wear or damage from misuse or use contrary to instructions.

Remedies: free repair or replacement, or—where applicable—price reduction or cancellation, according to consumer regulations.

17. Additional commercial warranty (if applicable)

If we offer commercial warranties, they will be detailed by model and do not affect your legal rights.

18. B2B purchases (companies and professionals)

For sales to businesses/professionals: consumer withdrawal rights do not apply; total liability for claims is limited to the amount actually paid for the affected order, except in cases of fraud or gross negligence; exclusive jurisdiction Barcelona, Spain.

19. Intellectual property and unauthorized uses

Trademarks, designs and content belong to Fluye or our licensors. Reproduction or exploitation without authorization is prohibited. Unauthorized **resale** and uses that create brand confusion are prohibited.

20. Customer opinions (UGC) and moderation

We may publish reviews and Q&A. We indicate when a review comes from a verified purchase; we moderate to remove spam, offensive language or personal data. We don't pay for reviews or alter them, except for compliance or formatting reasons.

21. Personal data and cookies (GDPR/LSSI)

Your privacy is governed by our **Privacy Policy** and **Cookie Policy** available on the Site. We may send you electronic marketing communications about products similar to those you've purchased; you can **opt out** at any time.

22. Sustainability, packaging and recycling (EPR)

We manage our packaging in accordance with extended producer responsibility systems (where applicable) and encourage proper separation. Check the recycling instructions on your package.

23. Force majeure

We won't be responsible for failures caused by things beyond reasonable control (like natural disasters, strikes, global logistics issues, supplier breakdowns).

24. Customer support, complaint forms, and ODR

25. Assignment, partial invalidity, and entire agreement

We can transfer our contractual position if we go through company restructuring. If one clause becomes invalid, the rest stays intact. This Contract, along with linked policies, is the complete agreement between us about the Site and your online purchase.

26. Applicable law and jurisdiction

Spanish law applies, except where your country's mandatory rules override it. Consumers: your local courts. B2B: courts in Barcelona, Spain.

27. Languages and electronic communications

If multiple versions exist, the Spanish version takes precedence in case of conflict unless local requirements say otherwise. You agree to receive contract communications electronically.
