This document integrates: (i) the **Terms of Use** of the website and digital services and (ii) the **Terms of Sale** applicable to online purchases. By using the website or making a purchase, you agree to this Agreement. Designed in accordance with EU and Spanish regulations (consumer protection, e-commerce, warranties), without prejudice to mandatory consumer rights in your EEA country.

We operate as an established seller in Spain for orders within the EEA.
2. Key Definitions
“Site”: fluebottle.com and subdomains. “Customer”/“Consumer”: natural person acting for non-professional purposes. “Company”/“B2B”: legal or professional entity. “Customized Products”: goods manufactured/altered according to your specifications (engraving, screen printing, etc.).
3. Scope and changes to the Contract
Applicable to access to/use of the Site and all online purchases. We may update these terms for legal or operational reasons; the current version is the one published on this page. Orders are governed by the version in effect at the **order confirmation**.
4. Capacity to contract and user account
You must be over 18 years of age and have legal capacity. If you create an account, you are responsible for its use and safekeeping. Notify us of any unauthorized use.
5. Pre-contractual information and correction of errors
Before you pay, we'll show you essential details, the total price (including taxes), shipping costs, and any restrictions. You can review your order and correct any errors before payment. We keep electronic records of the contract; you can request a reasonable copy.
6. Purchase process and order acceptance

We may reject orders due to suspected fraud, lack of stock, incorrect data or non-compliance with these conditions (full refund if applicable).
7. Prices, taxes and obvious errors
Prices in euros, plus VAT/IGIC/IPSI depending on the destination. We may update prices without affecting confirmed orders. If we detect a clear error in the price or description, we may cancel or correct the order with a full refund if you have already paid.
8. Promotions, coupons and transparency
Discounts cannot be combined unless otherwise stated. During sales, we display, where applicable, the **lowest previous price** from the last 30 days for the same channel/country. Customer reviews indicate whether they are from a **verified purchase**; we do not encourage paid reviews, nor do we hide them except in cases of violation of our terms of service.
9. Shipping, deadlines and delivery
We ship to Spain and EEA countries selected at checkout. Delivery dates are estimates. Delivery is considered complete upon receipt of physical possession. Carrier issues or force majeure may affect delivery times.
**Delivery Impossibility**: If delivery cannot be made due to reasons attributable to the customer (incorrect address/absence), we will reschedule upon payment of additional costs.
10. Transfer of risk and retention of title
The risk passes to the consumer upon delivery. Ownership of the goods is transferred only after full payment has been received (retention of title).
11. Right of withdrawal
Timeframe: 14 calendar days from delivery (or the last delivery date for multiple orders). How to exercise this right: send us an email indicating the order number and the goods to be returned. We will confirm receipt.
Refund: We will return payments including initial **standard** shipping costs without undue delay and at the latest within 14 days of your notification; we may withhold until we receive the goods back or convincing proof of return.
Product condition: responsible for depreciation due to handling beyond what is necessary to establish nature, characteristics and functioning.
Return shipping costs: You can return items at your own expense or use our shipping label. If you use our label within mainland Spain, we offer a €3.50 discount per order. For other regions/countries, the shipping cost will be displayed and deducted. Returns are free in the case of a defect, warranty claim, or error on our part.
12. Legal exclusions to withdrawal
This does not apply to: (i) **Personalized Products**; (ii) sealed goods unsuitable for return due to health/hygiene reasons that have been unsealed; (iii) services fully performed with your consent; and other legal assumptions.
13. Changes by preference (color/model)
Manage an exchange within 14 days as a return and place a new order. Subject to stock availability.
14. Customized Products — Content, Licenses and Tolerances
You declare that you have the necessary rights to the texts/logos/works provided and guarantee that they do not infringe on the rights of third parties or applicable regulations. We may reject content that is offensive, illegal, or contrary to our values.
**Limited License**: You grant us a non-exclusive, royalty-free license to manufacture/deliver your custom order and provide support. We may display anonymized photos of the finished product for portfolio purposes unless you request otherwise before manufacturing.
**Technical tolerances**: Reasonable variations in color may exist between devices and the actual finish; also in size/position of engraving. Images on the Site are for illustrative purposes.
15. Safe use and maintenance of the product
To preserve finish and functionality: do not use microwaves, ovens, or steam or boiling disinfection systems; avoid freezing; use caution with carbonated or very hot beverages due to overpressure; hand wash with warm, soapy water, and avoid chlorinated substances. Dishwashers may damage the paint/finish. See the product sheet for compatibility. Store the product clean and dry, uncovered, and away from heat sources. Keep out of reach of children unless supervised by an adult.
16. Conformity and legal guarantee
If you notice any non-conformity, please contact us with proof of purchase and supporting evidence. Spain: **3-year** legal warranty from delivery; in the rest of the EEA, at least the mandatory legal period (≥2 years). This does not cover normal wear and tear or damage caused by misuse or use contrary to the instructions.
Remedies: free repair or replacement, or —where appropriate— price reduction or termination, according to consumer regulations.
17. Additional commercial warranty (if applicable)
If we offer commercial warranties, they will be detailed by model and do not affect your legal rights.
18. B2B Purchasing (businesses and professionals)
For sales to businesses/professionals: the consumer right of withdrawal does not apply; total liability for claims is limited to the amount actually paid for the affected order, except in cases of fraud or gross negligence; exclusive jurisdiction Barcelona, Spain.
19. Intellectual property and unauthorized uses
The trademarks, designs, and content belong to Fluye or its licensors. Their reproduction or exploitation without authorization is prohibited. Unauthorized resale and use that creates confusion with the trademark are prohibited.
20. User-Growth Content (UGC) and Moderation
We may publish reviews and Q&As. We indicate when a review comes from a verified purchase; we moderate reviews to remove spam, offensive language, or personal information. We do not pay for reviews or alter them, except for compliance or formatting reasons.
21. Personal data and cookies (GDPR/LSSI)
Your privacy is governed by our **Privacy Policy** and **Cookie Policy** available on the Site. We may send you electronic marketing communications about products similar to those you have purchased; you can **opt out** at any time.
22. Sustainability, packaging and recycling (EPR)
We manage our packaging in accordance with extended producer responsibility schemes (where applicable) and encourage its proper separation. Please refer to the recycling instructions on the package.
23. Force majeure
We will not be liable for failures due to causes beyond our reasonable control (e.g., natural disasters, strikes, global logistical incidents, supplier disruptions).

25. Assignment, partial nullity and full contract
We may assign our contractual position in the context of corporate reorganizations. The invalidity of one clause will not affect the validity of the remaining clauses. This Agreement, together with related policies, constitutes the entire agreement between the parties regarding the Site and online purchases.
26. Applicable law and jurisdiction
Spanish law applies, without prejudice to mandatory rules of the consumer's country of residence. Consumers: jurisdiction of their domicile. B2B: courts of Barcelona, Spain.
27. Languages and electronic communications
If multiple versions exist, in case of discrepancy the Spanish version prevails unless required by local regulations. You agree to receive contractual communications electronically.
